29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. At the workplace, the employer welded a bracket to the tines of a Crown forklift model number 35SCTT, serial number 1A118875 in order to straighten and or repair cross-member sections of their Fraiser Racking System. The employer had not obtained written documentation from the manufacturer of the forklift to modify or use additional equipment on the forklift. Kroger Distribution Center, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 283858, citation number 1, item number 1, group letter b and was affirmed as a final order on June 7, 2012, with respect to the workplace at 2000 Nutter farms Lane, Delaware, OH 43015
