29 CFR 1910.22(c): Covers and/or guardrails were not provided to protect personnel from the hazards of open pits, tanks, vats, ditches, etc.: (a) On or about October 2, 2012, and at times prior, for the employees who clean the wash bay on a weekly basis and were exposed to burn and chemical hazards where tanks of water and chemicals such as phosphoric acid, cleaning solution and etching solution reach up to 150 degrees Fahrenheit and were not covered or otherwise protected from employees falling into them at Twin City Fan Companies, Ltd., located at 2201 North Ohlman in Mitchell, South Dakota.

29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: (a) On or about October 2, 2012, and at times prior, for the employees who enter the wash bay to clean on a weekly basis with exposure to burn and chemical hazards where uncovered vats of water and chemicals, including but not limited to phosphoric acid, cleaning solution and etching solution, reach up to 150 degrees Fahrenheit and permit-required confined space entry procedures were not followed to minimize those hazards and other recognized hazards, such as but not limited to, trip and fall or struck-by hazards, presented by the space, especially while the wash bay is in operation, at Twin City Fan Companies, Ltd., located at 2201 North Ohlman in Mitchell, South Dakota.
