29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    a) Jobsite 350 Brampton Avenue on or about October 11, 2012, employees performing framing work were using HITACHI, NR90AE, pneumatic nail guns without eye protection to install wooden studs, thus exposing the employees to eye injuries from ricocheting and flying debris. 29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:    a) Jobsite 350 Brampton Avenue on or about October 11, 2012, employees used a Caterpillar, TH580B, telescopic forklift to elevate personnel using an unapproved work platform to access and egress the Porte Cochere, thus exposing employees to ejection and struck-by hazard. The forklift manufacture only allows an approved work platforms to be used with the TH580B series forklift.       ABATEMENT CERTIFICATION IS NOT REQUIRED

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     a) Jobsite 350 Brampton Avenue on or about October 11, 2012, employees were observed working on open wooden truss, taking measurements and installing pre-cut 6-foot 2 X 4 wooden studs.  The employees were wearing harnesses and lanyards (conventional fall protection); however, the lanyards were not attached, thus exposing the employees to a fall hazard up to 20 feet.     ABATEMENT CERTIFICATION IS NOT REQUIRED
