29 CFR 1926.501(b)(13): 29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) 9 Ocean Pathway, Ocean Grove, NJ: The employees were performing roof repair of a residential home at a height greater than 20 feet from the ground level were not utilizing fall protection such as but not limited to personal fall arrest equipment, guardrails, etc., observed on or about 10/12/12. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. a) 9 Ocean Pathway, Ocean Grove, NJ: Employees were utilizing an extension ladder that was not extended at least 3 feet above the eave of the building. The employees were using the extension ladder to access a low sloped roof of a residential home to make repairs, observed on or about 10/12/12. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
