29 CFR 1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge: a) On or about October 10, 2012, and at times prior, Westchase Construction, Ltd., as controlling employer, did not ensure the safety of subcontractors working in the area of the guard rail system around the elevator shaft in the north east corner of the garage on the third level in that the system was tied together with wire and swung widely in an out when a light force was applied to it. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
