29 CFR 1926.1101(h)(2)(i):     The employer failed to implement a respiratory protection program in accordance with 29 CFR 1910.134(b) through (d) [except (d)(1)(iii)], and (f) through (m), which covers each employee required by 29 CFR 1926.1101 to use a respirator:    a)  U.S. Department of Justice Federal Bureau of Prisons, Federal Correctional Institution - Dublin, CA - On or about November 1, 2012 and at times prior thereto, a respiratory protection program was not implemented that covered each employee required to use a respirator in accordance with 9 CFR 1926.1101.  The plumber removing and disposing of a section of cracked/broken transite water pipe wore a white disposable face mask; a negative exposure assessment had not been conducted.

29 CFR 1926.1101(h)(3)(iii)(A):     The employer did not provide a half-mask air-purifying respirator, other than a disposable respirator, equipped with high-efficiency filters, whenever the employee(s) performed Class II and III asbestos jobs where no negative exposure assessment was available:    a)  U.S. Department of Justice Federal Bureau of Prisons, Federal Correctional Institution - Dublin, CA - On or about November 1, 2012 and at times prior thereto, the plumber removing a cracked/broken transite water pipe wore a white disposable face mask while removing and disposing of the pipe.

29 CFR 1926.1101(k)(9)(ii):     Training was not provided prior to or at the time of initial assignment and/or at least annually thereafter for employees likely to be exposed in excess of a permissible exposure limit (PEL) and for employees performing Class I through IV asbestos operations:    a)  U.S. Department of Justice Federal Bureau of Prisons, Federal Correctional Institution - Dublin, CA - On or about November 1, 2012 and at times prior thereto, the required annual asbestos training for Class III asbestos work was not provided to the FCI Dublin plumber required to repair a broken transite water pipe.  The employee's last asbestos training in accordance with 40 CFR 763 was completed on June 7, 2002.
