29 CFR 1910.95(g)(6):     At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels :    The employer did not ensure that employees exposed to noise at or above 85 decibels were given annual audiograms in that:    a) An employee working in the cutoff area was exposed to noise at 90.86 decibels time weighted average and the employee had a baseline in 2011 but no annual audiogram in 2012;    b) An employee working in the cutoff area was exposed to noise at 95.52 decibels time weighted average and the employee had not had an annual audiogram since 2009.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    The employer did not ensure that employees pouring molten aluminum at temperatures between 1350 and 1399 degrees fahrenheit in the main foundry and the green sand area wore adequate personal protective equipment to protect their legs from splashes of molten aluminum in that employees did not wear spats or leggings.

29 CFR 1910.132(e):     Defective and damaged equipment. Defective or damaged personal protective equipment shall not be used.    The employer did not ensure that defective or damaged personal protective equipment was not being used in that on or about November 29, 2012 metal pourers were observed wearing aluminized coats with the snaps broken at the bottom preventing the coat from closing when pouring molten aluminum at temperatures greater than 1300 degrees fahrenheit.

29 CFR 1910.133(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    The employer did not ensure that employees wore appropriate face protection when skimming the top of the molten metal to protect employees from splashes of the molten metal that may result in burns to the face in that employees only wore safety glasses.
