OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck by hazard:    a)  Star Roofing and Siding, Inc., provided and allowed its employees to use a Garlock Equipment Company 300 lbs. Hand Power Hoist that was not equipped with approved counterweights.    Among other methods, a feasible and acceptable mean of abatement is to use counterweight materials specified by the hoist manufacturer as described in the operating instructions and warning section of the Garlock Equipment Company 300 lbs. Hand Power Hoist owner's manual.    Star Roofing and Siding, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1) which was contained in OSHA violation number 314173865, citation 1, item 1, issued on March 30, 2010 and became final order on or about April 13, 2010 with respect to a workplace located at 418 E. 5th Street, Wilmette, IL 60091.    No abatement certification or documentation is required for this item.

29 CFR 1926.501(b)(4)(i):  Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels by personal fall arrest systems, covers or guardrail systems erected around such holes:    a)  Employees were not protected from the hazard of falling approximately 10 feet to the lower level while performing roofing work around unguarded skylights.
