29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition. On or about December 5, 2012 and times prior thereto, employer failed to maintain the work area around the chop saw and the Wysong Press Brake #MT 7-119 in a clean and orderly condition. Scrap material was strewn about the floor presenting a slip and trip hazard to employees working in the area.

29 CFR 1910.106(e)(2)(ii): "Containers." Flammable or combustible liquids shall be stored in tanks or closed containers. On or about December 5, 2012 and times prior thereto, employer stored a five gallon can of Acrylic Urethane Enamel without its cover in place. The Material Safety Data Sheet for this product lists it as a flammable liquid which could expose employees to burns in the event of a flash fire.
