OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Pulling Unit Rig #115, Lease: Hornet State 26, Well #1: On or about December 7, 2012, employees were exposed to fall and potential fire hazards due to the Geronimo Line not being insatalled for auxilary escape at the rig location during servicing operations.

29 CFR 1910.23(d)(1)(iii): Stairway(s) less than 44 inches wide having both sides open, did not have one stair railing on each side: On or about December 7, 2012, on pulling unit rig #115, employer did not ensure that stairways were equipped with guard rails. Employees were accesing the service rig working platform through stairways without guard rail on one side. This condition exposed employees to potential falls and struck-by hazards. J&M ENERGY SOURCES WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 312238967, CITATION NUMBER 1, ITEM NUMBER 1(a) AND WAS AFFIRMED AS A FINAL ORDER ON 11/06/2008, WITH RESPECT TO A WORKPLACE LOCATED AT WELL #1H, SHARAH LEASE, HWY 158, MIDLAND, TX 79701.
