29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe: a) At Lot 133 Grove St Gulf Shores, Alabama: On or about January 11, 2013 and at times prior; the employer exposed his employees to amputations hazards in that he failed to inspect a Makita skill saw used on site which had a piece of wood lodged in it to hold the guard in the up position and not allowing it to cover the blade when the saw was retracted.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At Lot 133 Grove St Gulf Shores, Alabama: On or about January 11, 2013 and at times prior; the employer exposed his employees to falls of 9.8 feet to ground below in that he failed to ensure an extension ladder used on site extended three feet above the landing area where employees were gaining access to the roof.

THE MEGA CONSTRUCTION CO, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVELANT STANDARD 29 CFR 1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 565321, CITATION 1, ITEM 1, AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 24, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT LOT 148 CAMBERWELL DR. DAPHNE, ALABAMA.
