29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: (a) Urbina Construction, Inc. at 2791 W. 52nd Ave., Denver, CO 80221: On and before 2/22/13, the employer did not ensure that the supported scaffold was designed by a qualified person, in that the scaffold wood platform was constructed at the job site by non-qualified personnel. A JLG TL943 rough terrain fork-lift was used to elevate an employee approximately 12 feet on a platform in order to perform work. This condition exposed the employee to a fall hazard of approximately 12 feet.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (a) Urbina Construction, Inc. at 2791 W. 52nd Ave., Denver, CO 80221: On and before 2/22/13, the employer did not ensure that employees were protected from a fall from elevation in that employees were working from a wooden scaffold platform used on a JLG TL943 rough terrain fork-lift without guardrails or other suitable fall protection system. This condition exposed the employee to a fall hazard of approximately 12 feet.
