29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person   Located on the exterior side of the structure workers were engaged in commercial construction activities renovating an existing restaurant. (Wendy's) A worker was working from the basket of a JLG  400S articulating, extensible, boom aerial lift exposed to a potential fall hazard from a height of 10.7 feet and regular and frequent inspections by a competent person were not conducted to ensure that the job site, materials, and equipment such as fall protection systems were maintained and utilized in a safe manner.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.      Workers were engaged in commercial construction activities renovating an existing restaurant. (Wendy's) A worker was working from the basket of a JLG  400S articulating, extensible, boom aerial lift exposed to a potential fall hazard from a height of 10.7 feet in that the worker was not attached to the basket or mast.
