29 CFR 1926.1053(b)(7): Ladders shall not be used on slippery surfaces unless secured or provided with slip-resistant feet to prevent accidental displacement. Slip-resistant feet shall not be used as a substitute for care in placing, lashing, or holding a ladder that is used upon slippery surfaces including, but not limited to, flat metal or concrete surfaces that are constructed so they cannot be prevented from becoming slippery. a. On or about February 02, 2025, located at 7039 Dublin Road, Delaware, Ohio, 43015, the employer did not ensure that working surface of the second-floor level balcony, where an 8-foot A-Frame stepladder was positioned, was clear of ice or other debris. The stepladder was positioned on the slippery, ice-covered surface when an employee used it to install window screws, thereby exposing the employee to a 15-foot fall hazard.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards. a. On or about February 2, 2025, located at 7039 Dublin Road, Delaware, Ohio, 43015, an employee was installing window screws from a step ladder that was positioned on a balcony, approximately 15 feet from the ground below. The employer did not ensure the employee was trained on the safe use and condition of the ladder..

On or about March 11, 2025, the employer failed to report an employee's in-patient hospitalization due to injuries sustained from a fall incident while working on the elevated working surface at the rear balcony of a new build home that occurred on February 02, 2025.
