29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and/or maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  At the front of the Pacific Islands Club (north side) on April 25, 2013, an employee operating the Makita Rotary Hammer, model HR3530, 35mm (1-3/8"), was not using eye protection while operating the Makita Rotary Hammer. Employee was exposed to potential eye injury from flying debris.

29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites:  At the front of the Pacific Islands Club (north side) on April 25, 2013, an employee operating the Makita Rotary Hammer, model HR3530, 35mm (1-3/8"), without ground fault circuit interrupter protection was exposed to electrical shock and/or electrocution.  The Makita Rotary Hammer was connected to a 100 foot extension cord, which was plugged into a 115 VAC  receptacle outlet.
