29 CFR 1917.112(a)(1): Vehicle curbs, bull rails, or other effective barriers at least 6 inches in height were not provided at the waterside edges of aprons and bulkheads: Whittier Terminal, Barge Whittier Provider: On or about May 1, 2013 and at times prior thereto, the employer had not provided an effective barrier at waterside edges. This condition exposed employees to caught-in and/or between hazards in the event of unintentional vehicle rolloover at waterside edges.

29 CFR 1918.85(j)(3): The employer did not ensure that each employee exposed to a fall hazard was protected by a fall protection system meeting the requirements of 29 CFR 1918.85(k): (a) Barge Whittier Provider, Port Bow Catwalk: On or about May 1, 2013 and at times prior thereto, a nine (9) foot wide section adjacent to the ladder access was not provided with a means of fall protection. This condition exposed employees to a fall hazard of up to 20 feet to the concrete deck below. (b) Barge Whittier Provider, Starboard Bow Catwalk: On or about May 1, 2013 and at times prior thereto, The fixed wire-rope guard rail used as fall protection was damaged. This condition exposed employees to a fall hazard of up to 20 feet to the concrete deck below.
