OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(I) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards due to inadequately maintained lift gates.  Lift gates were not being adequately maintained.  Older ones are sloped making it more difficult for employees to control loads that are moved out of trailers, thereby exposing them to fall and struck-by hazards.  Among feasible abatement measures is increasing the maintenance of lift gates in order to meet the manufacturers' specifications for lift gate slope.
