29 CFR 1926.502(h)(1)(iii): The safety monitor was not on the same walking/working surface and within visual sighting distance of the employee being monitored. On or about May 1, 2013 at or near 87 S. Enterprise, Conway, Arkansas, the assigned safety monitor was not on the same walking/working surface as the employees he was monitoring. The safety monitor was on the second level of a two level roof the workers were on the first level of the roof. Employees were performing job tasks such as the installation of flashing near the edge of the roof. This condition exposed employees to the hazard of falling from the roof.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: On or about May 1, 2013, at or near 87 S. Enterprise, Conway, Arkansas, a ladder was used for purposes other than the purpose for which it was intended. Specifically, a folding ladder was used to gain access from an upper roof level to a lower roof level. The ladder was in the folded position and was propped against the wall of the second story of the building. Employees at the worksite were performing roofing work on an approximate 300 square foot flat roof of a fire station. This condition exposed employees to the hazard of falling from an elevation.
