29 CFR 1910.107(b)(9): A clear space of not less than 3 feet on all sides was not kept free from storage or combustible construction: (a) Paint Booth No. 2, North side of the booth exterior; A table was against the booth. A card board box containing a 1/2 face air-supply SATA respirator was against the side of the booth. (b) Paint Booth No. 3, South side of the booth exterior; A cabinet was stored against the booth. A pail containing flammable Y32035 DuPont Paint Thinner was on top of the cabinet. Other one gallon containers of the paint thinner were inside the cabinet. (c) Paint Booth No. 3, North side of the booth exterior; A trash container was located against the booth exterior.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): (a) Spray paint booths No. 2 and No. 3; Spray paint containing volatile organic compounds was sprayed by paint employees. There had been no personal exposure hazard assessment to determine what personal protective equipment such as a respirator was necessary and what style would adequately protect employees. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or were not packed or stored to prevent deformation of the facepiece and exhalation valve: (a) North side of spray paint booth #2; A table located against the side of the spray booth had an open box on it. The open box contained a 1/2 face air supply SATA respirator. The respirator was not properly stored and was exposed to dust and contaminants and could have easily been deformed if something was set inside the open box. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

The container label was defaced such that the identity of the chemical contents were not legible. Employee interviews revealed that DuPont Y32035 Paint Thinner was inside the container. The thinner was used daily to clean paint guns.

The container label was defaced such that the hazard warnings of the chemical contents were not legible. Employee interviews revealed that DuPont Y32035 Paint Thinner was inside the container. The thinner was used daily to clean paint guns. (b) Between paint booth #2 and #3; A chemical container had been repurposed upon emptying as an MEK container. However the hazard warning had not been changed to reveal the hazards of MEK.
