OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: Logistic Warehouse: On May 29, 2013 and at times prior thereto, an employee was observed operating the JLG/Gradall Model G9-43A Manufactured -Telehandler, and not wearing the seat belt.

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: Logistic Warehouse: On May 29, 2013 and at times prior thereto, the ground pin was missing on a 25 foot extension cord, exposing employees who used the cord to power tools and electric fan to the hazards of contacting electricity.
