29 CFR 1926.25(a): During the course of construction, alteration, or repairs, debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures: Cos/LA Guam LLC - Andersen AFB Bldg. 26916, Fuel Canopy - On or about August 13, 2013, and at times prior thereto, piles of dirt debris were not cleared from the passageway between the scaffold ladder access and egress from the fenced in construction area (North East side of the structure) to prevent slips, trips and falls while employee carpenters moved to and from the scaffolding.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: Cos/LA Guam LLC - Andersen AFB Bldg. 26916, Fuel Canopy - On or about August 13, 2013, and at times prior thereto, the four story double pole (independent) scaffold, constructed by carpenters from wood, had not been designed by a qualified person. The scaffold was in use at the time of the inspection by: carpenters as a pathway to the top of the previously constructed and cured fuel canopy to lay forms on top for a concrete pour; as well as by subcontractor plasterers to work from while applying primer to the cured portion of the fuel canopy structure. No determination the scaffold was able to accommodate four times the intended load or constructed to ensure all pathways and working points were correctly braced, planked and guarded could be provided to ensure employees using the scaffold were not exposed to falls great than 10 feet. The scaffold was erected to the top of the 40 foot canopy.

29 CFR 1910.1200(g)(8): The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift: (Construction Reference: 1926.59) Cos/LA Guam LLC - Andersen AFB Bldg. 26916, Fuel Canopy - On or about August 13, 2013, and at times prior thereto, an MSDS for the Sherwin-Williams LOXON Concrete & Masonry Primer, interior/exterior Latex, White product at various locations at the worksite was not available at for review by carpenters at the worksite during their work shift. The MSDS was with the Cos/La Guam LLC Site Safety Officer overseeing a project at another location at Andersen AFB.
