OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: This violation was observed on or about June 12, 2013, Mid America Steel, Inc employees were exposed to falls greater than 20 ft. while standing on the railings of the Genie rough terrain scissor lifts. A feasible and acceptable method of abatement to correct this hazard would be to comply with the manufacturers instructions and keep feet firmly planted on the platform and use the scissor lift to obtain additional height.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: This violation was observed on or about June 12, 2013, employees performing dismantling operations of the steel structure over the outdoor arena at the State Fair grounds were not provided with adequate fall protection training enabling them to recognize the required use of fall protection while performing operations such as, but not limited to, straddling the I-beams at approximately 25 ft. above the ground.
