Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards:    (a) On or about December 14, 2016 and at time prior to that date, for the employees exposed to amputation hazards while operating the Mubea Ironworker, Model HP 1000/760 where the foot control pedal was not covered to prevent inadvertent operation in the structural two building at 92 NP Avenue, Fargo, North Dakota.    Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to provide a guard or cover for the foot control pedal that meets the requirement of the American National Standards Institute (ANSI) B11.5  1988 (R2008), Safety Requirements for Ironworkers, Section 4 Construction, Reconstruction, and Modification and specifically  4.3.5 Foot Control, which states: A foot control shall be protected so as to inhibit operation form falling or moving objects, or unintended operation by someone accidentally stepping on it.
