29 CFR 1910.178(o)(2): Load(s) were being handled which exceeded the rated capacity of the industrial truck(s): a) On July 24, 2025, at Mid America Steel, located at 5101 19th Avenue North in Fargo, North Dakota, the employer failed to ensure employees were not exceeding the load capacity while operating forklifts. A forklift operator exceeded the load capacity of the Combilift C12000XL forklift in the process of attempting to load two 40-foot bundles of rebar weighing approximately 11,968 total, The rebar bundles were placed outside the 24-inch load center on the forks and when the operator raised the rebar 20 feet, the Combilift tipped forward causing the rebar bundles to fall to the flatbed trailer below. This condition exposed an employee to struck-by and crushing hazards, specifically being struck by or crushed by loads of rebar or the forklift, when loads of rebar being handled exceeded the rated capacity of the forklift.

29 CFR 1910.178(o)(3): The long or high (including multiple-tiered) loads which may affect capacity were not adjusted: a) On July 24, 2025, at Mid America Steel, located at 5101 19th Avenue North in Fargo, North Dakota, the employer did not ensure forklift operators were adjusting long loads involving bundles of rebar that could affect the capacity of the forklift. Two 40-foot bundles of rebar weighing 11,968 lbs total, were not centered on the forks which exceeded the capacity causing the forklift to tip forward and the bundles of rebar to fall onto the flatbed semitrailer. This condition exposed an employee to struck-by and crushing hazards involving the forklift tipping and the rebar falling onto the flatbed.
