Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: a) roof of Arby's restaurant, 2022 Edinboro Road in Erie, PA. On or about June 8, 2013, employees were performing roofing activities including, but not limited to, heat welding and tearing off old roof materials, were not protected from falling 12 feet to the concrete surface below the work area.

On or about June 8, 2013, employees were utilizing a safety monitoring system as a means for fall protection. The safety monitor was cleaning and performing other activities that could take his attention away from monitoring duties.

On or about June 8, 2013, employees were performing roofing activities including, but not limited to, heat welding and tearing off old roofing materials, were utilizing a warning line system that was not continuous around the perimeter of the roof. b) roof of Arby's restaurant, 2022 Edinboro Road in Erie, PA. On or about June 8, 2013, employees performing roofing activities, including, but not limited to heat welding and tearing off old roofing materials, were utilizing a warning line system that was sagging to the roof surface. c) roof of Arby's restaurant, 2022 Edinboro Road in Erie, PA. On or about June 8, 2013, employees performing roofing activities, including, but not limited to heat welding and tearing off old roofing materials, were utilizing a plastic pennant tape as the warning line. The warning line was not made with rope, wire or chains. d) roof of Arby's restaurant, 2022 Edinboro Road in Erie, PA. On or about June 8, 2013, employees were performing roofing activities, including, but not limited to, heat welding and tearing off old roofing materials, were utilizing a warning line system that did not have a path of access to and from the ladder and warning line area.
