29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening: a) United Refining Co / 2000 Pennsylvania Ave, Warren, PA: On or about June 14, 2013 throughout the facility, including, but not limited to the fractionator, Passage openings from fixed ladders to the platforms were not equipped with swinging gate and/or other devices to prevent personnel from falling through the fixed ladder access opening.

29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits: a) United Refining Co / 2000 Pennsylvania Ave, Warren, PA: On or about June 14, 2013 and at times prior thereto, the diesel engines on the cooling towers were not maintained according to the manufacturer's original design in that the diesel engines were origninally manufactured with over speed protection which had been removed.
