29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder.      Location: 2950 Jonrose Ave, Cincinnati, OH    On or about 17 June, 2013 the rear loading platform was not guarded by a railing or equivalent. Employees were exposed to the open platform that is 4 feet about the road surface.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.147(c)(7)(i): The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees.       a) On or about 17 June, 2013 employees were not trained to perform lockout procedures in order to isolate and control hazardous energy when servicing equipment including but not limited to Mazak CNC milling machines and drill presses.         The Cincinnati Mine Machinery Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.147(c)(7)(i), which was contained in OSHA inspection number 312945207, citation number 1, item number 1 and was affirmed as a final order on 4/7/2009, with respect to a workplace located at 2950 Janrose Ave, Cincinnati, OH.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.      Location:2950 Jonrose Ave, Cincinnati, OH    On or about 17 June, 2013 the employer failed to establish, document and utilize a program for the control of hazardous energy during repair operations on metal cutting, grinding and milling machines.  A documented lockout/tagout program was not being employed to protect employees during maintenance operations.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
