29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift: At the project on or about August 23, 2013, a competent person did not inspect the trench or the person that inspected the trench was not competent. Employees and the construction manager said the construction manager was the competent person. The construction manager said he had not been onsite prior to the start of work in the trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: At the project on or about August 23, 2013, employees in a trench were not protected from cave-ins by an adequate protective system. Employees were in the trench to replace a water lateral on an existing 6 inch diameter PVC water pipe. A portion of the trench was excavated with a backhoe late in the previous afternoon. The rest of the trench was excavated with backhoe in the morning. There were no cave-in protective systems. The faces of the trench were not sloped at an angle of 1.5 horizontal or more to 1 vertical. The trench was approximately 13 feet long, 7 feet wide at the top, and 3.5 feet wide at the bottom. The south face of trench was nearly vertical and about 5 feet, 9 inches deep. The north face of the trench was sloped at an angle of about 0.59 horizontal to 1 vertical and about 6 feet, 10 inches deep. The trench soil was analyzed by OSHA's lab to be Type B. Since the soil was previously excavated to install the existing water line and lateral, the soil was Type C.
