29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. a) Pro Steel, Inc. on or about October 18, 2013, at the address of 828 Phillips Ave. Toledo, OH: The employer failed to ensure employees were protected from falls while performing steel erection activities atop a commercial structure. While installing insulation material from the unprotected elevated surface, employees were exposed to falls of up to 17 ft. to the ground below. Pro Steel, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.760(c)(3), which was contained in OSHA inspection number 313715153, citation number 1, item number 1 and was affirmed as a final order on February 10, 2010, with respect to a workplace located at 10682 Maltese Point, Falcon, CO.

29 CFR 1904.40(a): The employer did not provide an authorized government representative the records within the four business hours. a) Pro Steel, Inc. on or about October 18, 2013 at the address of 828 Phillips Ave. Toledo, OH: The employer did not provide the representative of the Dept. of Labor, OSHA 300 logs for the year 2013 upon request in a timely manner. Two requests were made on two different days to the company representative, requesting records kept under Part 1904.
