29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.  At the back side of the project site on November 8, 2013, eye protection was not worn while painting in the overhead position.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed  At the side of the building fronting Chalan San Antonio, on November 8, 2013, an eight foot aluminum stepladder was used in the folded/closed position and leaned against the exterior wall to access the upper wall area.  The top of the exterior wall was about 10 feet to the ground.  An employee utilized the stepladder as a working platform in order to paint the upper concrete wall.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the project site on November 8, 2013 and at times prior thereto, the employer did not develop, implement, or maintain a written Hazard Communication Program for employees who were exposed to hazardous materials including but not limited to; paints and solvents.
