OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by a or caught between hazards while operating a Carryall 295 Two-Wheel Drive Club Car: This violation was discovered on or about October 13, 2013; and at times prior thereto; where the employer did not ensure that operators of the Carryall 295 Two-Wheel Drive Club Car were trained and evaluated prior to operating the vehicle.

29 CFR 1904.39(a): Within eight (8) hours after the death of any employee from a work-related incident or the in-patient hospitalization of three or more employees as a result of a work-related incident, the employer did not orally report the fatality/multiple hospitalization by telephone or in person to the Area Office of the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor, that was nearest to the site of the incident. The employer also did not use the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742): This violation occurred on or about November 8, 2013; where the employer did not orally report a fatality from a work-related incident within eight hours after the death. The accident victim passed away at 4:54 pm on Friday, November 8, 2013 and was not reported until Tuesday, November 12, 2013.
