29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. At the front of the project on November 12, 2013, eye protection was not worn while driving rebar into the ground with a claw hammer. Employee was exposed to flying metal fragments striking the eyes.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement: At the front of the project on November 12, 2013, there were no rebar caps on three rebars that protruded about 8 inches from driveway forms. Employees were observed working above rebars, thus exposing themselves to impalement hazards.
