29 CFR 1910.146(d)(3): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations: Employees of Subco Foods, Inc. entered cooking kettles #1, and #2, and holding tanks #1m #2, and #3, in order to clean them. The employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations to remove hazardous conditions including but not limited to, heat from the heating elements, mechanical energy from the agitators, and the engulfment hazards from the water lines. Certification and documentation are required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.147(d)(3): All energy isolating devices that were needed to control the energy to the machine or equipment were not physically located and operated in such a manner as to isolate the machine or equipment from the energy source(s): Employees of Subco Foods, Inc. entered cooking kettles #1 and #2 and holding tanks #1, #2, and #3 in order to clean them. The energy isolating devices which were needed to control the release of water in the tanks were not physically located and operated in such a manner as to isolate the equipment from the energy source. Certification and documentation are required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.147(d)(4)(i): Lockout or tagout devices were not affixed to each energy isolating device by authorized employees: Employees of Subco Foods, Inc. entered cooking kettles #1 and #2 and holding tanks #1, #2, and #3 in order to clean them. The mixer who performed the work and was an authorized employee did not affix a lockout or tagout device to the energy isolating device during entrance into the tank(s). Certification and documentation are required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: Employees of Subco Foods, Inc. were adding water to electric batteries for forklifts exposing them to corrosive chemicals. The employer did not provide suitable facilities for quick drenching or flushing of the eyes. The saline solution in the portable eye wash station had not been changed since April 28, 2006. This item was corrected during the inspection.
