On or about December 11, 2013, on a structure, an employee using a Hitachi pneumatic air nail gun was not wearing safety glasses, exposing himself to being hit by nails or flying debris.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a. On or about December 11, 2013, on top of a structure, an employee performing framing operations was not protected from a 9-foot 3-inch interior fall hazard by use of a guardrail system, safety net system, personl fall arrest system or any alternative fall protection.   b. On or about December 11, 2013, on top of a structure, an employee performing framing operations was not protected from a 14-foot 1 inch fall hazard by use of a guardrail system, safety net system, personal fall arrest system or any alternative fall protection.
