Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm. On or about December 12, 2013, and at times prior thereto in Building 1 and 2, employees were exposed to struck-by hazard when the Horizontal Injection Molding Machines (HIMMs) were not maintained in accordance with manufacturers and ANSI/SPI B151.1 requirements. This includes, but is not limited to the following instances: a. (Instance deleted in Informal Settlement agreement) The IMPCO 1500, UBE 2750 number 32, and UBE 4000 number 37 plastic injection molding machines were modified without instructions or prior approval from the manufacturer, exposing employees to struck-by hazard. b. The repair and remaining modification in the barrel head of the IMPCO 1500 plastic injection molding machine was not evaluated and repaired to ensure the level of safety of the HIMM was not reduced, exposing employees to a struck-by hazard. c. The cycle on the IMPCO 1500 was interrupted for an extended period of time after a piece of the machine blew out of the right side of the barrel head. The employer did not to ensure that troubleshooting procedures were followed during normal operations and failure operations, exposing employees to struck-by hazards.

29 CFR 1910.212 (a)(1): One or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. On or about December 12 2013, and at times prior thereto, the employer did not ensure a purge guard and barrel guard were provided on the IMPCO 1500 Horizontal Injection Molding Machine (HIMM), exposing employees to thermal, electrical, and struck-by hazards.
