29 CFR 1910.120(q)(8)(i): Those employees who are trained in accordance with paragraph (q)(6) of this section shall receive annual refresher training of sufficient content and duration to maintain their competencies, or shall demonstrate competency in those areas at least yearly: On or about December 13, 2013, in the facility, employees, including, but not limited to, Cumene and Phenol Operators, were required to respond to hazardous substance releases, or potential releases, as noted in the employer's written Emergency Response Action Plan. Employees were not provided with annual refresher training of sufficient content and duration to maintain competencies in areas required in paragraph (q)(6).

29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: On or about December 13, 2013, in the facility, employees required to perform chemical manufacturing operations, including, but not limited to, Cumene and Phenol Operator duties, were exposed to the hazards associated with flash fires. The employer did not provide and require employees to use flame-resistant clothing to protect against burn injuries.
