29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) An effective hearing conservation program was not developed and implemented that included: a monitoring program, annual audiometric testing program (audiograms) and training for employees exposed to more than 50 % of the dose. 1) The machine operator at Line 536 was exposed to continuous noise at 71.9% of the permissible daily noise exposure (10 hour time weighted average sound level of 83.39 dBA) or an equivalent sound level of approximately 87.6 dBA during the 600 minute sampling period on March 29, 2014. 2) The machine operator at the Wizard and Excalibur Lines was exposed to continuous noise at 71.43% of the permissible daily noise exposure (10 hour time weighted average sound level of 83.39 dBA) or an equivalent sound level of approximately 87.6 dBA during the 589 minute sampling period on March 29, 2014.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein: (a) A five gallon bucket of black ink near Line 328 was not labeled as to it's identity and hazard classifications.
