29 CFR 1926.451(b)(4): Each end of a platform, unless cleated or otherwise restrained by hooks or equivalent means, shall extend over the centerline of its support at least 6 inches (15 cm).    (a) North end of building above garage, on or about 4/10/14:  24 foot aluminum pick did not have sufficient bearing surface at the exterior wall cleat to exend over the centerline of it's support at least 6 inches, exposing employee to a fall hazard of 4 to 14 feet.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  (a) North end of building above garage, on or about 4/10/14:  Carpenter's bracket scaffold system (wood brackets and aluminum picks) was not inspected by a competent person prior to use.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.    (a) At the jobsite, during roofing operations, on or about 4/10/14:  Employees were exposed to fall hazards of 10 to approximately 25 feet without training in proper use of fall protection system(s), including but not limited to installation and use of the vertical lifeline system and use of associated body harness and rope-grab.

McAvoy Development LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 952009, citation number 1, item number 1(a) and was affirmed as a final order on 3/7/14, with respect to a workplace located at 13/14 Widgeon Way, Waterford, NY 12188.

McAvoy Development LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 952009, citation number 1 , item number 1(b) and was affirmed as a final order on 3/7/14, with respect to a workplace located at 13/14/ Widgeon Way, Waterford, NY 12188.
