29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used: (a) Front of the building, upper roof, On or about August 13, 2015 - the ladder jack scaffold system was not equipped with a separate access ladder. Scaffold deck to the ground elevation was approximately 18 feet, 3 inches. (b) Front of the building, lower roof, on or about August 13, 2015 - the ladder jack scaffold system was not equipped with a separate access ladder. Scaffold deck to the ground elevation was approximately 8 feet, 9 inches.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: (a) Front of the building, On or about August 13, 2015 - the employee that was installing roof shingles and brackets was attached to a vertical lifeline rope grab system that had considerable slack, creating a fall hazard that would exceed 6 feet.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system: (a) Front of the building, On or about August 13, 2015 - no fall protection was being used for the employee that was installing roof shingles and brackets, working from a ladder jack scaffold system. Scaffold deck to ground elevation was approximately 18 feet, 3 inches. McAvoy Development , LLC., was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.451(g)(1)(I), which was contained in OSHA inspection number 967349, citation number 2, item number 1, and was affirmed as a final order on January 14, 2015, with respect to a workplace located at 356 Westwoods Court, Schenectady, NY 12303. McAvoy Development , LLC., was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.451(g)(1)(I), which was contained in OSHA inspection number 952009, citation number 1, item number 1c, and was affirmed as a final order on March 7, 2014, with respect to a workplace located at 33/14 Widgeon Way, Waterford, NY 12188.
