29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    a). On or about 4/12/14, at 356 Westwoods Ct, Schenectady, NY 12303. An employee, delivering roofing material, was using a ladder to climb onto or off of the roof. The extension ladder was used to access the second floor roof, and it's side rails did not extend at least three feet above the roof. Employees were exposed to fall hazards of approximately 22 feet.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold were not protected by a personal fall arrest system:    a). On or about 4/12/14, at 356 Westwoods Ct, Schenectady, NY 12303. Employees were working from a ladder jack scaffold without fall protection exposing them to fall hazards of up to 18 feet.     McEvoy Development, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1)(i), which was contained in OSHA inspection number 952009, citation number 1, item number 1,c and was affirmed as a final order on 3/7/14, with respect to a workplace located at 33/14 Widgeon Way Waterford, NY 12188.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system nor were employee(s) provided with an alternative fall protection measure under provision 1926.501 (b):    a). On or about 4/12/14, at 356 Westwoods Ct, Schenectady, NY 12303. Employees were installing felt papering shingles on a new 10 on 12 pitch roof without conventional fall protection. Employees were exposed to fall hazards of approximately 18 feet.       McAvoy Development, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 952009, citation number 1, item number 1,d and was affirmed as a final order on 3/7/14, with respect to a workplace located at 33/14 Widgeon Way, Waterford, NY 12188.
