29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, or other approved alternative fall protection system. (a) A&R Construction at 1600 Iron Horse Drive, Longmont, CO 80501: On and before January 10, 2014, the exposing employer did not ensure that employees were protected from injury, in that one employee was engaged in setting 2nd floor trusses while standing on top of the interior walls of an apartment building with a fall hazard of approximately 9 feet without the use of a fall protection system.

29 CFR 1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall be rigged such that employees can neither free fall more than 6 feet, nor contact any lower level: (a) A&R Construction at 1600 Iron Horse Drive, Longmont, CO 80501: On and before January 10, 2014, the exposing employer did not ensure that the personal fall arrest systems used by four employees limited the fall distance to 6 feet, nor prevented contact with the lower level. Four employees engaged in roofing activities were wearing fall harnesses attached to anchored vertical lifelines; however, their rope grabs were improperly adjusted so that the fall protection systems did not provide fall protection. Conditions resulted in employees exposed to fall hazards of greater than 6 feet, and with high potential of contacting the ground below at approximately 9 feet below.

29 CFR 1926.503(a)(2): The employer did not assure that each employee had been trained by a competent person qualified in the standards contained in subpart M: (a) A&R Construction at 1600 Iron Horse Drive, Longmont, CO 80501: On and before January 10, 2014, the exposing employer did not ensure that each employee who is exposed to fall hazards had been trained by a competent person, in that approximately four employees were exposed to fall hazards greater than six feet associated with setting 2nd floor trusses on top of framed interior walls while using personal fall arrest systems incorrectly. This condition exposed the employees to a fall of approximately 9 feet to the ground below.
