OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employement and a place of employement which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards up to 15' as the employer did not ensure personal fall protection system anchorage points employees were using would sustain 5,000 lbs. of force.   On or about 4/29/14, at the Tucker facility, maintenance employees using body harnesses and lanyards when entering into bag houses were anchoring to parts of the bag house that had not been designed or tested for that use.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening.  On or about 4/29/14, at the Nitrogen bag house area, platforms on the bag houses had ladder openings that were not guarded and instead left open and exposed to falls of 15' to lower levels.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  On or about 4/29/14, at the Tucker facility, the employer did not establish a Lockout/Tagout Program with energy control procedures, authorized employee training and periodic inspections.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1904.29(b)(1): A Log of all recordable work-related injuries and illnesses (OSHA From 300 or equivalent), was not completed in detail as required by the regulation.  On 4/29/2014, at the Tucker facility, for Case #2 the OSHA 300 log was not kept in the detail the regulation requires in that the Column F description did not detail the injury encourntered by the employee.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
