OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:      a) On or about May 14, 2014 and at times prior, employees were exposed to serious injuries while operating a Hyster S50XL forklift without wearing the seatbelt.     Abatement note:    Feasible and acceptable methods to correct these hazardous conditions would be to follow the requirements in accordance to the instructions required for the powered industrial trucks ASME B56.1-1993 - Safety Standard for Low and High Lift Trucks; or to follow the safety instructions set forth in accordance with the manufacturer operator's instruction manual.    1. Wear the safety belt at all times while operating the forklift.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:      a) On or about May 14, 2014 and at times prior, employees were exposed to serious injuries while storing metal and materials on storage racks that were missing the middle support bar and were not installed properly. The employer recognized the hazard that would cause serious physical harm to the employees and was not enforcing the safety of the employees.    Abatement note:    Feasible and acceptable methods to correct these hazardous conditions would be to follow the requirements in accordance to the instructions required for the storage racks ANSI MH16.1-2008 Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks:    1. The American National Standard requires storage racks approved and verified by ANSI requirements for due process, consensus, and other criteria for approval that have been met by the standards developer.     2. Storage racks should be installed according to the manufacturer's instruction manual.    3. The design of the storage racks should include the specifications and load capacities.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating conditions:      a) On or about May 14, 2014 and at times prior, employees were exposed to injury while operating a Hyster S50XL forklift with broken back-up light, back-up signal alarm, and horn. The forklift had not been repaired or replaced, and had remained in service.

29 CFR 1910.304(f)(1)(iv): Overcurrent devices for circuits rated 600 volts, nominal, or less, were not readily accessible to each employee or authorized building management personnel:      a) On or about May 14, 2014 and at times prior, employees were exposed to serious injuries from two energized electrical knife switches that were blocked with sheet metals and other materials. The electrical knife switches were not readily accessible to the employees in the event of an emergency.
