29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a)  Work Site:  Springfield Avenue & Tuscan Road, Maplewood, NJ and at the Corporate Office at 1257 River Road, Edgewater, NJ.    Employee(s) were not instructed to recognize and avoid unsafe conditions and were not trained as to what OSHA regulations applied to them at the job site so that they could control or eliminate any hazards or other exposure to injury while engaging in trenching and excavation operations.    Violation observed on or about 06/18/2014.

29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:    a)  Work Site:  Springfield Avenue & Tuscan Road, Maplewood, NJ    A daily inspection of the excavation was not made by a competent person. Excavation had visible deficiencies, such as but not limited to, no protective cave-in system with a depth of up to 7 feet and the impalement hazard of unprotected rebar throughout the floor of the excavation.    Violation observed on or about 6/18/2014.

29 CFR 1926.652(a)(1):      Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):      a) Work Site:  Springfield Avenue & Tuscan Road, Maplewood, NJ.    Laborer working in an excavation was exposed to struck-by and crushing injuries in the up to 7 foot deep excavaton which was not adequately sloped or protected by shields or shoring.                                     Violation observed on or about 06/18/2014.
