Section 5(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards:   (a)  Manko Window Systems, Inc. at 17500 E 22nd Ave, Aurora, CO 80011:  On or before June 21, 2014 employees were exposed to crushing and struck-by hazards while unloading wooden crates of glass from an enclosed shipping container and were working within the fall zone of the crates.  Employees were attempting to position the 4,000 lb. wooden crates for removal from the shipping container when two of the crates tipped over and crushed an employee; fatality injuring him.  The employer did not ensure steps had been taken to protect employees from crushing and struck-by hazards.     Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following:     A feasible method to correct the hazard is to develop and implement a written procedure that prevents employees from being exposed to crushing and struck-by hazards while unloading wooden crates of glass from enclosed shipping containers.  Safe work practices must be established to ensure employees remain clear of the fall zone while removing metal banding and that steps are taken to secure crates from falling over during the unloading process.

29 CFR 1910.147(c)(4)(i):  Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:      (a)  Manko Window Systems, Inc. at 17500 E 22nd Ave, Aurora, CO 80011:  On or before June 23, 2014 machine specific, step-by-step procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section including, but not limited to, the following equipment:      1) VFL Auto Sealer  2) CNCs  3) Spandrel coating equipment  4) Tempering furnace equipment      Abatement Note:  Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.  The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:      1) A specific statement of the intended use of the procedures;  2) Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy;  3) Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them; and  4) Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures.

29 CFR 1910.178(a)(4):  Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:      (a)  Manko Window Systems, Inc. at 17500 E 22nd Ave, Aurora, CO 80011:  On or before June 23, 2014 the employer did not receive the manufacturer's written approval for a modification or addition to the Hyster forklift, model S40FT, serial number F187V03363C.  The lift truck was used to move loads that weighed approximately 4,000 pounds by using an 8-foot web sling that was attached to each tine.  This condition exposed employees to the hazard of operating modified forklifts without the manufacturer's approval.    (b)  Manko Window Systems, Inc. at 17500 E 22nd Ave, Aurora, CO 80011:  On or before June 23, 2014 the employer did not receive the manufacturer's written approval for a modification or addition to the Yale forklift, model GLC080LGNGAE085, serial number B818N02431Y.  A WESCO JigRig is attached to the tines of the forklift and is used to lift and move crates that can weigh up to 4,000 pounds.  This condition exposed employees to the hazard of operating modified forklifts without the manufacturer's approval.

29 CFR 1910.212(a)(1):  Machine guarding was not provided to protect operators and other employees from hazards created by ingoing nip points, rotating parts, flying chips and sparks:      (a)  Manko Window Systems, Inc. at 17500 E 22nd Ave, Aurora, CO 80011:  On or before June 23, 2014 guarding was not provided to protect employees from hazards created the by the moving parts on the Intermac glass CNC machine, in that the safety interlock located on the access door was not functioning.  This condition exposed employees to cut and amputation hazards.

29 CFR 1910.219(f)(3):  Sprocket wheels and chains which were seven feet or less above floors or platforms were not enclosed:      (a) Manko Window Systems, Inc. at 17500 E 22nd Ave, Aurora, CO 80011:  On or before June 23, 2014 a drive sprocket and chain on the tempering furnace equipment was not guarded, in that the equipment was in operation while the guard had been removed.  This condition exposed the employees to amputation hazards of ingoing nip points.      (b) Manko Window Systems, Inc. at 17500 E 22nd Ave, Aurora, CO 80011:  On or before June 23, 2014 a drive sprocket and chain on the spandrel coating equipment was not guarded, in that a section just below the conveyor table is exposed.  This condition exposed the employees to amputation hazards of ingoing nip points.

29 CFR 1910.1200(f)(5)(ii):  The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the appropriate hazard warnings:    (a) Manko Window Systems, Inc. at 17500 E 22nd Ave, Aurora, CO 80011:  On or before June 23, 2014 the employer did not ensure that containers in the facility were labeled, tagged or marked with the appropriate hazard warnings, including but not limited to, the identity of the chemicals contained therein, appropriate precautions, personal protective equipment needed while handling and at least general information regarding the hazards of the chemicals.  Denatured alcohol had been poured into empty plastic sports drink bottles and was used to clean machinery and equipment.  This condition potentially exposed employees to exposure to hazardous chemicals.
