29 CFR 1926.451(g)(4)(iv): Midrails were not installed at a height approximately midway between the top edge of the guardrail system and the platform surface: a) Four Seasons Drive, North Caldwell, NJ Employees were working on the 2nd level of a tubular welded framed scaffold. The cross bracing units were being used as the top rail of the guardrail system however there was no mid rail present, thereby exposing employees to an approximate 12ft fall hazard. Violation observed on or about 08/25/2014

29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, and the employer could not demonstrate that a wider space was necessary: a) Four Seasons Drive, North Caldwell, NJ Employee was working on the 2nd working level of a tubular welded framed scaffold. The scaffold platform was not fully planked as it contained only 2 out of 6 planks, thereby exposing the employee to an approximate 12ft fall hazard. Violation observed on or about 08/25/2014 Alexandre Paiva Construction, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.451(b)(1) which was contained in OSHA Inspection Number 314978461, Citation 1, Item 1, issued on 09/30/2011 and became a final order on 10/26/2011, with respect to a workplace located on 198 North Main Street, Spring Valley, NY 10977.
