29 CFR  1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:  a. 829 South Ave., Plainfield, NJ - Netherwood Flats  The employer did not ensure that working levels of each scaffold were planked where the space between planks was less than 1 inch.  Employees engaged in concrete masonry activities worked from tubular welded frames scaffolds mounted on casters (manually propelled mobile scaffold) where the working level planks had gaps greater than 1 inch.  Violation was observed on or about November 24, 2021

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a. 829 South Ave., Plainfield, NJ - Netherwood Flats  The employer did not ensure employees were provided a safe means of access to scaffold platforms.  Employees engaged in concrete masonry activities accessed the caster mounted welded tubular frame scaffolds (manual propelled mobile scaffold) by climbing the frame ladders which were more than 2 feet above the point of access and climbing cross braces as a means of access and egress.  Violation observed on or about November 24, 2021

29 CFR  1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a. 829 South Ave., Plainfield, NJ - Netherwood Flats  The employer did not ensure employees working from scaffolds were protected from falls.  Employees engaged in concrete masonry activities used welded tubular frame scaffolds mounted on casters (manually propelled mobile scaffold) where the working level was greater than 10 feet, and the employees stepped across from the scaffold to stand on the column forms, and were not utilizing any means of fall protection.  Violation observed on or about November 24, 2021  Alexander Paiva Construction Inc. was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1), which was contained in OSHA inspection number 1379420, citation number 02, item number 1, and was affirmed as a final order on 1December 9, 2019, with respect to a workplace located at 102 Midland Avenue, Elmwood Park, NJ.  Alexander Paiva Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1), which was contained in OSHA inspection number 1176092, citation number 01, item number 2/a and was affirmed as a final order on 2/03/2017, with respect to a workplace located at 407 Halsey Street, Newark, NJ.
