29 CFR 1926.501(b)(1):     Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    Ground floor of a residence located at 20505 Taylor Street, Elkhorn, NE:  The employer is failing to ensure that a floor opening where a stairwell will eventually be installed was protected with any type of fall protection/prevention system such as a guard rail system.  This exposes the employees to falls of 9.85 feet.        Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of the abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.

29 CFR 1926.1053(b)(13):     The top or top step of a stepladder shall not be used as a step:     Ground floor of a residential structure located at 20505 Taylor Street, Elkhorn, NE:  The employer failed to ensure that five employees including the Foreman utilized a 6 foot Keller A-Frame ladder correctly to access the ceiling joists and roof of the structure.  In climbing into the ceiling and roof area, each employee utilized the top step of the ladder due to the ladder being too short for the application.        Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of the abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.

29 CFR 1926.1060(a):     The employer is failing to provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.    Worksite located at 20505 Taylor Street, Elkhorn, NE and Throughout the company:  The employer is failing to ensure that employees are trained on the proper use of portable ladders.  In this case, the employees and foreman are incorrectly using an A-Frame ladder and were not trained on the proper use.    Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of the abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. 29 CFR 1926.501(b)(13):     Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    The employer is failing to protect employees from fall hazards when performing framing activities.  This was most recently documented on the job site at 20505 Taylor Street, Elkhorn, NE 68022 where employees were observed installing roof sheathing and rafters on a new residential home without the use of fall protection.  Instances include but are not limited to:      i.        Installing sheathing for the roof along the west side of the home while the catch platform was located along the northwest corner of the roofline.  Two employees were observed obtaining sheathing from the platform and then carrying it to the south to install it on the exposed rafters.  The catch platform is 16 feet long and the roofline was measured at 49 feet which exposed the employees while they worked in the unprotected area (33 feet).  The employees had been working on the roof for approximately 1.5 hours.  The fall distance was measured at 12.5 feet.                  ii.      Installing rafters on the structure along the north side of the home without fall protection of any type.  Three persons were observed installing the rafters and were exposed to both interior and exterior falls.  The interior falls were measured at 12 feet and the exterior falls were 12.8 feet.        Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citations.

29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    The employer is failing to provide adequate training to employees on the recognition of potential fall hazards and on methods or procedures that may be used to mitigate the risk of falling such as the implementation of various forms of fall protection/restraint systems while working on residential homes where the ground to eave height is greater than 6 feet.  The most recent example of this was found on the job site located at 3909 N. 191st Street, Elkhorn, NE 68022 where the employer has untrained employees installing the roof sheathing on a new residential home without the use of fall protection.  Instances include but are not limited to:      I.  Installing sheathing for the roof along the west side of the home while the catch platform was located along the northwest corner of the roofline.  Two employees were observed obtaining sheathing from the platform and then carrying it to the south to install it on the exposed rafters. 29 CFR 1926.451(c)(2)(v):     Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:    Worksite located at 20505 Taylor Street, Elkhorn, NE:  The employer is failing to ensure that a platform supported by a fork lift is attached to the forks.   There are two employees using the platform who are exposed to falls of 12.5 feet.        Affordable Exteriors Inc. was previously cited for a violation of this occupation safety and health standard or its equivalent standard 1926.451(c)(2)(v), which was contained in OSHA Inspection number 906655, Citation Number 1, Item Number 1 and was affirmed as a final order on October 11, 2013, with respect to a workplace located at 176th Street and Patrick Avenue, Omaha, NE, 68116.        Abatement certification is required for this violation. The abatement certification sheet is enclosed for the citations.
