29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: Worksite located at 18921 Ruggles Street, Elkhorn, NE: The employer failed to ensure that anyone working under his direction received instruction on the recognition and avoidance of unsafe conditions applicable to their environment. An employee received amputation injuries as a result of not being adequately trained on the use of a pneumatic nail gun. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. Worksite located at 18921 Ruggles Street, Elkhorn, NE and throughout the company: The employer has failed to require the use of personal protective equipment whenever an employee is exposed to one of the situations described above. Specifically, employees utilizing nail guns are not required to use safety glasses. The action of forcefully firing a nail through lumber may cause splintering which can become a projectile. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
