29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):     a)  Employees were exposed to the hazard of falling, approximately 28 feet to the ground, while performing masonry work from tubular welded frame scaffold platform that was not fully planked.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:     29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) The employer did not train and evaluate employees operating the Terex TH844C all terrain forklift.     Polo Masonry Builders, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(l)(1)(i), which was contained in OSHA inspection number 108513, citation number 1, item number 1 and was affirmed as a final order on December 13, 2011, with respect to a workplace located at 3634 W. Montrose Ave., Chicago, IL 60618.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:     a)  Employees engaged in masonry work were not protected from the hazards of falling while working from a tubular welded frame scaffold platform elevated approximately 12 feet above the ground.      Polo Masonry Builders, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 108513, citation number 1, item number 2 and was affirmed as a final order on December 13, 2011, with respect to a workplace located at 3634 W. Montrose Ave., Chicago, IL 60618.  No abatement certification or documentation is required for this item.
